Strengthening Halal Product Supervision Governance by the Halal Product Guarantee Agency (BPJPH) in Terms of Legal Certainty

Abstract

The state has a supervisory role. Article 29 paragraph 2 of the 1945 Constitution requires the state to guarantee the freedom of every citizen to embrace their respective religions and worship according to their religion and beliefs. To obtain legal certainty regarding the halal status of products, supervision is necessary. On August 1, 2024, the Halal Product Guarantee Agency (BPJPH) revoked the halal certification of Roti Okko products, which were found to have violated several provisions, and were found to have used unregistered halal labels as product variants. Objectives: (1) To explain the form of halal product supervision by BPJPH from the perspective of Indonesian positive law, (2) To find a model to strengthen halal product supervision from the perspective of the principle of legal certainty. The research method used a qualitative approach with normative and empirical legal methods. The nature of the research is descriptive analysis. The types of data used are secondary and primary data. The analysis technique is a combination of normative and empirical analysis. The results of the study show that the current form of supervision consists of audits and inspections, administrative sanctions, and community participation through complaints and reports. Efforts to improve BPJPH supervision can be carried out in several stages, including Improving the Normative Foundation, Increasing Institutional Capacity, Utilizing Technology for Transparency, and Optimizing Law Enforcement Mechanisms.
